1. Acceptance of Terms

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Account Terms

• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account and password.
• You must notify us immediately of any unauthorized use of your account.
• You may not use the Service for any illegal or unauthorized purpose.
• One person or legal entity may not maintain more than one free account.
• You may not use the Service to store or transmit malicious code or interfere with the integrity of the Service.

3. Payment Terms

• Paid plans are billed in advance on a monthly or annual basis, depending on your chosen billing cycle.
• All fees are exclusive of taxes, which will be added where applicable.
• You authorize us to charge your payment method for all fees incurred.
• Prices are subject to change with 30 days' notice. Changes apply at the start of your next billing cycle.
• Refunds are provided at our discretion, except where required by law.

4. Cancellation and Termination

• You may cancel your account at any time through your account settings or by contacting support.
• Upon cancellation, your access continues until the end of your current billing period.
• We may suspend or terminate your account if you violate these Terms or engage in abusive behavior.
• Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination.
• We reserve the right to discontinue the Service with 90 days' notice.

5. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of byCORE. The Service is protected by copyright, trademark, and other laws.

You retain ownership of any data you upload or generate through the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing and improving the Service.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

When you connect third-party platforms to the Service, you authorize us to access and process data from those platforms for the purpose of generating reports and insights. We do not share your integration data with third parties except as described in our Privacy Policy.

7. AI-Generated Content

The Service uses artificial intelligence to generate insights, recommendations, and analysis. While we strive for accuracy, AI-generated content is provided for informational purposes only and should not be relied upon as the sole basis for business decisions. We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

8. Limitation of Liability

To the maximum extent permitted by law, byCORE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service, including AI-generated insights
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims arising from or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months prior to the event giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless byCORE and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be filed in the courts located in Calhoun County, Michigan.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
